5. Common misunderstanding: Ifrepparttar tenant has been trying to move out but can't find a new place, repparttar 110492 eviction hearing judge will not makerepparttar 110493 tenant get out.

Truth: Inability to find a new place is not a legal defense, andrepparttar 110494 judge will order you to get out -- even if it means that you and your children will become homeless.

6. Common misunderstanding: Ifrepparttar 110495 tenant goes torepparttar 110496 eviction hearing, repparttar 110497 judge will automatically giverepparttar 110498 tenant more time to move.

Truth: Sometimes, if there is a really sad situation (a health problem, young children),repparttar 110499 judge may askrepparttar 110500 landlord to giverepparttar 110501 tenant extra time. Rarely, repparttar 110502 judge may requirerepparttar 110503 landlord to give extra time. Often, repparttar 110504 judge will not require any extra time, in part becauserepparttar 110505 judge knows thatrepparttar 110506 landlord still has to wait another 3 days

7. Common misunderstanding: Ifrepparttar 110507 tenant gets or gives a 30 day eviction notice, repparttar 110508 tenant does not have to pay rent duringrepparttar 110509 30 day period.

Truth: The tenant's rent obligation continues for every dayrepparttar 110510 tenant is inrepparttar 110511 rental unit, throughrepparttar 110512 30 day period, even thoughrepparttar 110513 landlord (orrepparttar 110514 tenant) has given a termination of tenancy notice. It is understandable thatrepparttar 110515 tenant may needrepparttar 110516 rent money, in order to move to a new place. But ifrepparttar 110517 tenant does not payrepparttar 110518 rent as it comes due, thenrepparttar 110519 landlord can giverepparttar 110520 tenant a 72 hour nonpayment of rent notice and evictrepparttar 110521 tenant, long beforerepparttar 110522 30 day period runs out.

8. Common misunderstanding: The landlord may make you pay any unpaid rent at an eviction hearing (an FED).

Truth: The only things a landlord can get at an FED are: 1) a judge's order (called a judgment) thatrepparttar 110523 tenant must get out at a certain day and time, and 2) a judge's order thatrepparttar 110524 tenant payrepparttar 110525 landlord forrepparttar 110526 landlord's court costs, prevailing party fee, and attorney fees (if any). Ifrepparttar 110527 landlord wants to makerepparttar 110528 tenant pay any unpaid rent, repparttar 110529 landlord will have to suerepparttar 110530 tenant in a separate lawsuit, often in Small Claims Court, for a judgment forrepparttar 110531 rent money. (Legal Aid has other handouts which explain howrepparttar 110532 landlord must go about collectingrepparttar 110533 judgment fromrepparttar 110534 tenant).

Find other options . Look, discreetly, for other means of taking care of your son, some of which may be seeking outside help, alternating caretaking with mother and mother-in-law...etc. There are always other ways of finding a reasonably good caretaker for your baby. For me, I have resorted to hiring a live-in babysitter who takes care of my children when I am working.

Talk to other people about your problem . There will be other people who facerepparttar same problem you're facing. Sometimes, talking about it to another person will simply make it less significant and put things back into perspective. Especially whenrepparttar 110491 someone is someone you trust completely. Just remember to keep an open mind...

Consult other family members . Other people may have a tip or two up their sleeves on how they survivedrepparttar 110492 ordeal.

Swallowrepparttar 110493 pill . Take it from me, it is not worth it to argue with your baby's daycaregivers. Ultimately, repparttar 110494 welfare of your baby is in their hands. You're onrepparttar 110495 losing end if you piss them off. It is simply not worth it. Noone and I mean, NOONE will be able to UNDERSTAND or deal withrepparttar 110496 problems FOR YOU. Pick your battles wisely, smile and bear with it. Sometimes, bearing with it,repparttar 110497 other parties (like your day caregivers) may start to see something in you and things will starting becoming better. I mean, who knows?
